Most owners in Nieuwpoort know about the obligation to declare their accommodation to Toerisme Vlaanderen. Many are unaware of the planning layer, which comes first: Flanders treats switching from a dwelling to tourist accommodation as a change of use, subject to authorisation. Here are the three levels of rules that apply in Nieuwpoort, in the order in which they need to be dealt with.

Change of use: what does it mean?

In Flanders, turning a dwelling intended for residential use into tourist accommodation constitutes a planning change of use (functiewijziging). In principle, this change requires an environmental permit (omgevingsvergunning), issued by the municipality, unless the property was authorised as a holiday home from the outset or an exemption applies.

In practice, there are three distinct situations:

  • The property is already authorised as a holiday home: no change of use is needed.
  • The property is authorised as a dwelling and you let it as a whole holiday home: an environmental permit for a change of use is in principle required.
  • You let one or more rooms while living in the property: an exemption exists, under strict conditions.

What exemptions exist in Flanders?

Flemish regulations provide for two main exemptions from the permit requirement for a change of use to tourist accommodation. The first concerns occasional letting of the whole property, the second the letting of rooms within an occupied home.

  • Occasional letting of the whole property: the exemption applies if the property is let for a maximum of four periods of thirty consecutive days per year, and if the property is not in breach of land-use plans, regulations or the conditions of a previous permit (source: omgeving.vlaanderen.be, regulations on changes of use requiring a permit).
  • Letting rooms: the exemption applies if residential use remains the main use of the building and if the floor area allocated to tourist accommodation remains smaller than the living area and does not exceed 100 m².

One technical point matters: the thirty-day period starts running from the beginning of the letting, whether or not all thirty days are let. A series of weekends therefore uses up the quota quickly. For a second home let throughout the season on Airbnb or Booking, the exemption does not apply in practice.

Municipalities may impose additional conditions. Before letting in Nieuwpoort, checking with the city's Omgeving department remains essential.

What the city is preparing: the 2026 timetable

Nieuwpoort does not yet have a formal municipal policy on holiday homes: no dedicated planning regulation, no published zoning, no quota. Today, it is the land-use plan applicable to the plot (RUP, BPA or subdivision) that decides, and the answer changes from street to street. A municipal framework is being prepared in a municipal council committee set up in March 2025, with an opinion expected at the municipal council by the end of December 2026. Its meeting of 16 September 2026 has on its agenda the policy vision on holiday homes and a planning enforcement plan.

The direction has already been set, and it is worth reading before any purchase: in November 2025 the committee indicated that there is no question of allowing holiday homes where they are prohibited today, and that what will be examined is a possible adjustment or refinement of the planning requirements in the zones where they are currently permitted, including the town centre. The city's 2026-2031 multi-year plan likewise announces a limit on the number of holiday homes in favour of permanent housing.

The figures presented to the committee in February 2026 show the scale of the issue: around 100 holiday homes that are unauthorised and cannot be regularised, 952 that are unauthorised but potentially regularisable under the regional zoning plan, mainly in Nieuwpoort-Bad, and 29 regularisable under the applicable RUP. The city is considering facilitating regularisation for whole buildings, via the managing agent, rather than flat by flat. According to the latest published minutes, it did not yet have a planning inspector empowered to order a halt to operations, but was preparing for one. None of this is in force as at 10 September 2026: these are announced intentions, to be monitored.

Which regional obligations apply in Nieuwpoort?

All tourist accommodation in Flanders must be declared to Toerisme Vlaanderen and hold a positive fire safety certificate. This obligation stems from the decree on tourist accommodation (Logiesdecreet of 5 February 2016, in force since 1 April 2017) and applies in Nieuwpoort as everywhere else in the Flemish Region.

The procedure takes place in three stages:

  1. Declaration (aanmelding) to Toerisme Vlaanderen via the operator portal. The accommodation receives a unique registration number.
  2. Fire safety certificate: the accommodation must meet the basic standards in the annex to the Logiesdecreet. The inspection is carried out by an approved body; since 29 September 2025, HOSTEA has worked with ACEG for these inspections.
  3. Display of the registration number on online listings, as required by the regulations.

Among the basic standards most often failed on the coast: smoke detectors. The standard requires optical detectors certified EN 14604 with a sealed, non-replaceable ten-year battery. A detector with a replaceable battery is refused at inspection (HOSTEA data, 2026).

What municipal taxes apply in Nieuwpoort?

Nieuwpoort applies two municipal taxes that add up on a holiday home: the tax on letting room-related accommodation and the second-residence tax. The city's three tax regulations were adopted by the municipal council on 21 August 2025 for the tax years 2026 to 2031, with fixed rates for the whole period and no indexation.

The tourist accommodation tax

Annual flat rate per unit: €600 for a holiday home, apartment or studio equipped for 1 to 6 people, €1,200 for 7 to 12 people, €2,000 above that, and €175 per room let without its own kitchen or bathroom. It is payable by the operator, a notion that covers the person on whose behalf the accommodation is operated and the holder of an operating agreement; if there are several operators, they are jointly and severally liable, and if the operator is unknown, the owner is deemed to be the operator. The tax remains due without a permit, and even if the accommodation remains unoccupied. It is indivisible, with no pro rata during the year.

No return is required: the city assesses the tax on the basis of known data, including data from Toerisme Vlaanderen. The capacity declared at registration therefore serves, in practice, as the tax base, and an over-declared capacity is paid for every year. The regulation allows the operator to pass the tax on to guests "fairly", without setting a cap.

The second-residence tax

Payable by the owner of any dwelling where no one is registered in the population register on 1 January: €1,100 a year for a floor area of at least 40 m², €1,015 below that, €700 for a residential caravan. In the event of a sale, the seller must notify the city by registered post within two months of the deed, failing which they remain liable for the tax. The regulation makes no exception for a property let during the season.

Why the two add up, and what it costs

The second-residence regulation contains only one anti-cumulation clause, relating to campsites, and the regulation on room-related accommodation contains none. The city therefore wrote an exclusion where it wanted one, and not for holiday homes. This cumulation results from a combined reading of the regulations: the city does not publish an overall figure, and it is prudent to have it confirmed in writing by the Finance department before building a budget on it.

Cumulation of the tourist accommodation tax and the second-residence tax in Nieuwpoort, annual amounts, situation assessed on 1 January.
Situation on 1 January, no one domiciledTourist accommodation taxSecond-residence taxAnnual total
Apartment under 40 m², 1 to 6 people€600€1,015€1,615
Apartment of at least 40 m², 1 to 6 people€600€1,100€1,700
Accommodation for 7 to 12 people€1,200€1,100€2,300
Accommodation for more than 12 people€2,000€1,100€3,100

There is no per-night tourist tax in Nieuwpoort. For comparison, the same configuration costs €1,475 a year in Koksijde and €1,025 in Middelkerke (environmental tax included), where the second-residence tax does not come on top. The rates are those of the regulations in force: have them validated by the city or your accountant before any profitability calculation.

In what order should you tackle these steps?

The order matters, because each step determines the next. Dealing with the declaration to Toerisme Vlaanderen before checking the planning situation means you may have to regularise after the fact, sometimes with a property already online.

  1. Check the planning designation of the property with Nieuwpoort's Omgeving department and determine whether a permit for a change of use is needed.
  2. Bring the accommodation up to fire safety standards and obtain the certificate from an approved body.
  3. Declare the accommodation to Toerisme Vlaanderen and collect the registration number.
  4. Regularise the municipal tax situation: second residences and tourist accommodation.
  5. Publish the listing with the registration number displayed.

FAQ

Do you need a permit to let your apartment short-term in Nieuwpoort?

In principle yes, if the property is authorised as a dwelling and you let it as a whole holiday home. This switch constitutes a planning change of use requiring an environmental permit issued by the municipality. Exemptions exist for occasional letting and for letting rooms.

What is the rule of four periods of thirty days?

Flanders exempts from the permit requirement for a change of use any accommodation let for a maximum of four periods of thirty consecutive days per year, provided it is not in breach of planning rules. The thirty-day period runs from the start of the letting, even if it is not let in full.

Can I let rooms without a permit in Nieuwpoort?

Yes, under conditions. The exemption applies if residential use remains the main use of the building and if the floor area allocated to tourist accommodation remains smaller than the living area and does not exceed one hundred square metres. The municipality may add conditions.

What municipal taxes apply in Nieuwpoort to a second home that is let?

The two taxes add up according to a combined reading of the two regulations, to be confirmed in writing by the Finance department: the second-residence tax, €1,100 a year (€1,015 under 40 m²), payable by the owner if no one is domiciled at the address on 1 January, and the tourist accommodation tax, €600 a year for accommodation for 1 to 6 people (€1,200 for 7 to 12, €2,000 above that), payable by the operator. That makes €1,700 a year for a standard apartment. Fixed rates from 2026 to 2031, regulations of 21 August 2025.

Is Nieuwpoort going to ban holiday homes?

No general ban has been announced, but no relaxation either. In November 2025 the municipal council committee in charge of the matter indicated that zones where holiday homes are prohibited will remain so, and that the rules could be adjusted or refined where they are permitted. An opinion is expected at the municipal council by the end of December 2026. In the meantime, only the land-use plan applicable to your plot is authoritative.

Do you need a fire safety certificate in Nieuwpoort?

Yes. The Logiesdecreet of 5 February 2016, in force since 1 April 2017, requires every operator of tourist accommodation in Flanders to hold a positive fire safety certificate, issued after an inspection of the basic standards by an approved body.

Which smoke detector is accepted at the inspection?

An optical detector certified EN 14604, fitted with a sealed, non-replaceable ten-year battery. Detectors with replaceable batteries are refused at the fire safety inspection. This is one of the most common reasons for non-compliance in properties on the Belgian coast.

In what order should you take the steps?

First check the planning designation with Nieuwpoort's Omgeving department, then bring the accommodation up to fire safety standards and obtain the certificate, next declare the accommodation to Toerisme Vlaanderen, and finally settle the municipal tax situation before publishing the listing with the registration number.
